Electronic signatures in Thailand: when they equal paper

Whether an e-signature holds up for a contract in Thailand needs checking case by case, but a land or condo sale is valid only once registered at the Land Office.

Whether an electronic signature is good enough for a given contract in Thailand is not something we can confirm from an official text yet, so we check it case by case rather than assume it. One thing is settled: no signature method replaces registration. A sale of land, a house or a condominium unit is valid only once the contract is made in writing and registered at the Thai Land Office (Civil and Commercial Code, s. 456). So a buyer who cannot be in Thailand for the registration itself uses a power of attorney on the Land Department's own form, or travels for the day.

In short

  • Whether an electronic signature is enough for a given contract is not yet confirmed from an official text; check it before you rely on one.
  • A sale of land, a house or a condo needs a written contract registered at the Land Office — no signature method changes that.
  • Buying a condo, or registering a long lease, from abroad usually means a power of attorney on the Land Department's form, or a visit in person.
  • A lease of immovable property is subject to stamp duty on the total rent and any key money for the whole term; an unstamped instrument that is subject to duty cannot be used as evidence in a civil case until the duty is paid.
  • From 28 February 2027, Thailand's apostille should replace the embassy step for public documents from Convention countries that have not objected to Thailand joining.

What the Electronic Transactions Act says

We have not yet confirmed from a primary source which contracts Thailand's law on electronic transactions covers and which it excludes. Until we can point to the text, we treat statements like "the law accepts an e-signature for most contracts" as unverified, and we recommend asking a lawyer before you rely on one for anything that matters.

One related point is settled: a Thai company's board can meet online, unless its articles of association forbid this and provided the applicable rules on electronic meetings are followed. Since 7 February 2023, a director who attends a board meeting this way counts for the quorum and the vote (Civil and Commercial Code, s. 1162/1). That rule is about running a company, not about selling land, and it does not extend to a Land Office transaction.

Contracts you can sign electronically

For an ordinary private contract — a lease, a reservation agreement, a services agreement — the law's position on e-signatures is one of the points we have not confirmed yet. What we can say with a source behind it concerns tax, not the signature itself: a lease of immovable property attracts stamp duty of THB 1 for every THB 1,000 or part thereof of the total rent and any key money for the whole term (Stamp Duty Schedule, item 1, Revenue Department), normally paid by the lessor, and an instrument that is subject to duty but has not been stamped cannot be used as evidence in a civil case until the duty is paid (Revenue Code, ss. 104, 118). That rule applies whatever method the parties used to sign.

The Revenue Department ran an online route for paying stamp duty on documents made up to 31 December 2025. Whether that route still works for a document made in 2026 is something we check case by case before telling a client to rely on it.

Document form, witnesses and registration: Land Office, POAs, wills

Some documents have their own rules on written form, witnesses or registration, set by specific statutes rather than by the Electronic Transactions Act:

DocumentWhat Thai law requiresSource
Sale or gift of land, a house or a condo unitWritten contract, registered at the Land OfficeCivil and Commercial Code, ss. 456, 525
Power of attorney for a Land Office transactionThe Land Department's own form, with witnesses; land with a title deed uses form ท.ด.21, a condominium unit uses a separate Land Office formLand Department forms, as practised by the Land Office
An ordinary written willWritten, dated, signed by the testator before at least two witnesses present together, who sign at the same time; no notarisation neededCivil and Commercial Code, ss. 1656, 1705
Licence to use a registered Thai trademarkWritten and registered with the Department of Intellectual PropertyTrademark Act, s. 68

The Land Department's own warning printed with its ท.ด.21 power-of-attorney form calls for at least two witnesses. Forms and document lists can differ for land, a house or a condominium unit, so we suggest checking the exact form and witness requirement with the Land Office you will register at before the signing.

A deal at a distance: e-sign, POA or a visit

Registering a condo purchase, or a lease that needs registration, without flying to Thailand almost always comes down to the same choice: a power of attorney, or a visit. Simply signing a lease that will not be registered is a different question — check with the landlord and your lawyer which signing method the document itself requires.

Registering a transfer online between Land Offices has reached Phuket since 13 January 2026, but only for land held under a chanote title, and only with the owner present in person — so it is not a way to sign from abroad. The Land Department's e-QLands Plus app is built for Thai residents with a Thai digital ID, and we do not suggest it to a foreign buyer.

For a power of attorney signed outside Thailand, the usual chain is: a notary in your own country, then that country's foreign ministry, then the Thai embassy or consulate — missions apply this differently, so we check the current requirement with the embassy and the Land Office before preparing the document. From 28 February 2027, Thailand's apostille should replace the embassy step for public documents, including notarial acts, from Convention countries that have not objected to Thailand joining, but that is not yet in force.

Our team prepares the power of attorney on the Land Department's form and advises on how to get it certified in your country, so the document the Land Office receives matches what it expects.

Signing in a way you can prove later

A few habits make a signed document easier to rely on if a dispute comes up:

  • Keep the signed file together with a record of who signed and when.
  • Pay any stamp duty when the document is signed, not later.
  • Agree, in writing, which language version of a bilingual contract controls.

What to do next

If you are buying from abroad, a lease needs signing while you are out of the country, or a document needs to travel between countries, our team can prepare the power of attorney or notarise the document and explain the steps that follow, with the cost agreed before the work starts (notarisation and power of attorney, [прайс]).

For the legalisation chain itself, see document legalisation and apostille for Thailand and what changes for apostilles from 2027. If the document needs signing or witnessing in Thailand, our page on notarisation in Phuket explains what our office can do.

Frequently asked questions

Is a lease signed with an e-signature tool valid?

Thailand's rules on electronic signatures for a private lease are not fully confirmed here. What is settled is the stamp duty: a lease of immovable property is taxed on the total rent and any key money for the whole term, at THB 1 for every THB 1,000 or part thereof (Stamp Duty Schedule, item 1, Revenue Department), and an unstamped lease cannot be used as evidence in a civil case until the duty is paid. Ask your landlord, or send it to our team, before you sign.

Can a condo purchase be completed fully online?

No. A transfer of ownership is valid only once the contract is made in writing and registered at the Thai Land Office, and registration needs either the buyer's presence or a power of attorney on the Land Department's own form. We can prepare that power of attorney and explain how to get it certified in your country.

Will a Thai court accept an electronic signature?

We have not found a confirmed official answer to this question. If a signed document matters to your case, show it to a lawyer before you rely on it in court.
